- 참여 민주주의에서는 각계각층의 다양한 분야의 사람들이 자신들의 이익과 입장을 정치에 반영할 수 있으며, 정책과정에 참여할 수 있다. 이들은 집단 구성원들의 공통 목표 또는 이익을 표출하고 달성하기 위하여 집단을 형성하고 여러 가지 활동을 수행하는데, 이러한 집단을 이익집단이라 한다. 이익집단은 여론의 유도, 입법부에의 접근, 행정부에 대한 압력, 사법부에의 접근, 정당에 영향, 초국가적 단체와의 연대의 방법을 가지고 압력을 행사하는 등의 정치활동을 한다. 교원단체도 교원 구성원의 이익과 단체의 공통 목표를 위하여 활동하는 단체로 이익단체 중 하나이나 교원단체가 타 이익단체와 같이 정치활동을 하는 데에는 많은 제약점이 있다. 이 논문에서는 첫째, 이익집단과 교원단체 그리고 정치활동에 관한 이론적 개념을 고찰한다. 둘째, 우리나라 교원단체의 정치활동을 이익집단의 정치활동 6가지 방법으로 분석한다. 셋째, 외국에서의 교원 및 교원단체 정치활동을 허용하는 범위와 정도의 실태를 살펴본다. 넷째, 우리나라의 교원과 교원단체의 정치활동에 관한 사회적 인식과 지지도를 살펴본다. 다섯째, 우리나라 교원과 교원단체의 정치활동에 제약을 주는 제도적 법률을 살펴보고 개정의 필요성을 고찰한다. 여섯째, 교원과 교원단체의 정치활동을 보장을 위한 사회적 공감대 형성과 교원과 교원단체의 정치활동을 금지하거나 제한하는「국가공무원법」,「교육기본법」,「정당법」「공직선거법」,그리고「사립학교법」의 조항 삭제 또는 개정을 제안한다.
- Alternative Abstract
- In participatory democracy people of all social standings can show their interests and positions through politics and join policy making processes. They form groups to express their common goals or interests or accomplish them, and conduct various activities. They are called Interest group. Interest groups conduct political activities; they can mold public opinion, have access to the legislative body, exercise political influence to the administration, have access to judicature, have influence on parties, exercise political influence with ultranational organizations. Teachers' union is one of organizations that aim to accomplish teachers' interests and their common goals, but teachers' union is put in many restraints in doing political activities like other interest groups do. So I conducted this study as follows. First, I examine general ideas, functions and characteristics of interest group and teachers' union, and general ideas of political activities. Second, I make analysis of political activities by teachers' union in Korea by the above six ways. Third, I investigate political activities by teachers' union in foreign countries. I examined political activities allowed in US, Japan, France or England in social, cultural or institutional context. Fourth, I investigate social recognition of political activities by teachers' union in Korea and their approval rating. Fifth, I study institutional laws that can restrict teachers' union in Korea and their political activities and insisted on revision of related laws. Sixth, I emphasize the importance of creating consensus to assure their right for conducting political activities. Also I suggest abolishment or revision of regulations that prevent or restrict political activities of teachers' union in「 the Government Officials Act」, 「the Fundamentals of Education Act」, 「the Political Party Law」, 「 the Election Law 」, 「the Private Schools Law 」.
